These Terms of Service ("Terms") govern your use of HushType, a macOS application developed by Groovy Lab LLC ("we", "us", or "our").

By downloading, installing, or using HushType, you agree to these Terms. If you do not agree, do not use the application.

1. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use HushType for personal and commercial purposes, subject to these Terms and the Apple Media Services Terms and Conditions.

2. Description of Service

HushType is a voice-to-text application that runs locally on your Mac using OpenAI's Whisper AI model. All processing occurs on your device; no audio or transcription data is transmitted to external servers.

3. Acceptable Use

You agree not to:

  • —Reverse engineer, decompile, or disassemble the application
  • —Use the application for any unlawful purpose
  • —Attempt to circumvent any security features
  • —Redistribute or resell the application

4. Intellectual Property

HushType and its original content, features, and functionality are owned by Groovy Lab LLC and are protected by international copyright, trademark, and other intellectual property laws.

The Whisper AI model used in HushType is developed by OpenAI and is used under the MIT License.

5. Disclaimer of Warranties

HushType is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

  • —Accuracy of transcriptions
  • —Fitness for a particular purpose
  • —Non-infringement
  • —Uninterrupted or error-free operation

Speech recognition technology is imperfect. Transcriptions may contain errors, and accuracy varies based on audio quality, accent, background noise, and other factors. You are responsible for verifying the accuracy of any transcriptions before relying on them.

6. Limitation of Liability

To the maximum extent permitted by law, Groovy Lab LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • —Your use or inability to use the application
  • —Any errors or inaccuracies in transcriptions
  • —Any unauthorized access to or alteration of your transmissions or data (though we note that HushType does not transmit any data)

7. Indemnification

You agree to defend, indemnify, and hold harmless Groovy Lab LLC and its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the application or violation of these Terms.

8. Modifications to Service

We reserve the right to modify or discontinue HushType at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the service.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of any changes by updating the "Last Updated" date. Your continued use of HushType after such changes constitutes acceptance of the new Terms.

Your use of HushType is also subject to the Apple Media Services Terms and Conditions available at apple.com/legal/internet-services/itunes/.
